These terms govern your use of nar.pub, a managed nar-herder service operated by Cyclic Systems Limited (company number 16878561, registered office 71-75 Shelton Street, London, England, WC2H 9JQ). By creating an account or using the service you agree to these terms.
The service. nar.pub sets up and runs nar-herder instances on your behalf, connected to an S3-compatible bucket you supply. Each deployment is reachable at a public Fly-issued URL, which is the management endpoint nar-herder uses to import narinfos and nars; substitutes are served by your S3 bucket directly with whatever access policy you set on it. nar-herder itself is free software; you can also self-host it.
Your account. You must be at least 16 to use the service. You are responsible for keeping your login credentials and any second-factor credentials secure, and for activity on your account. Notify us promptly at support@nar.pub if you believe your account has been compromised.
Acceptable use. You must not use the service to:
- store or distribute illegal content, malware, or material that infringes someone else's rights;
- breach the terms of your S3 provider or any other third party;
- harass, abuse, or threaten others, or help others do so;
- attempt to compromise, overload, or interfere with the service or other users' deployments;
- resell or rent access to the service without our prior written consent.
We may apply reasonable rate limits or other technical controls to keep the service available to everyone. To report abuse, email abuse@nar.pub.
Your content. You are responsible for what's in your bucket and for having the rights to distribute it. You grant us a non-exclusive licence to host and serve that content solely as needed to operate the service. We do not claim ownership of your content.
Fees and billing. Some plans are paid; pricing is shown when you create a deployment. Paid plans bill monthly or annually via Paddle, our merchant of record, who handles payment processing, applicable taxes, and tax invoices. Your contract for the payment is with Paddle; your contract for the service is with us. If a free trial is offered, your subscription converts to paid at the end of the trial unless you cancel before then; you can cancel from your dashboard at any time during the trial without charge. Charges continue until you cancel or the deployment is destroyed.
Refunds and cancellation. You can cancel a deployment at any time from your dashboard. Choose Destroy now to stop the deployment immediately, or Cancel at period end to keep it running until the end of the current billing period and then stop. Charges stop once the deployment is destroyed.
You can request a refund within 14 days of any payment, in line with Paddle's refund policy. As Paddle is the merchant of record for your payment, you may also have rights under Paddle's standard buyer terms; nothing in this clause affects those rights or your statutory rights as a consumer.
Suspension and termination. We may suspend or terminate your account or a deployment if you breach these terms, if a payment fails and is not resolved within a reasonable grace period, or if we are required to do so by law. You can close your account from your settings once you've destroyed any deployments under it; closure removes your account data, subject to the retention periods in our privacy policy. Closing your account does not affect your S3 bucket — that remains under your control.
No warranty and liability. The service is provided "as is" and "as available", with no warranty that it will be uninterrupted, error-free, or fit for any particular purpose. Nothing in these terms limits liability that cannot be limited by law (including for death, personal injury, or fraud). Subject to that, our total liability to you in any 12-month period is limited to the fees you paid us in that period, and we are not liable for indirect or consequential losses, loss of profits, loss of revenue, or loss of data.
Indemnity. You agree to indemnify us against third-party claims and the costs and losses arising from them, where the claim relates to your content or to your use of the service in breach of these terms.
Changes. We may update these terms. For significant changes we will notify account holders by email at least 30 days in advance; you may close your account before the change takes effect. If you keep using the service after the change takes effect, that counts as acceptance.
Governing law. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
